
Day 2 of the Trial today, and Alec Peters was on the stand for his Direct Questioning from his attorney, followed by cross examination by Paul’s Attorney. Now for those of you who are not lawyers, or well versed in what happens in a courtroom, when the plaintiff’s attorney (in this case, Alec Peters’ Attorney) gets done with his direct questioning, the Defense Attorney gets to ask questions of the witness (in this case Alec Peters). However (and this is a VERY BIG POINT), the Defense Attorney CANNOT ask questions about things that have NOT yet been entered into the Court Record (also known as evidence). Today, during the cross examination of Alec Peters, Paul’s Defense Attorney continually attempted to do so, this caused Alec’s Attorney to raise Multiple objections, which were all Sustained (granted to the objecting party). Once again the court was sent out to an early lunch by the Judge in the case.
Paul’s Attorney made the following statements to the Court “I’m Not what Paul wanted, and I believe that is what Alec wanted all along”. Considering the fact that Paul’s other Lawyers quit representing him due to the fact that Paul did not have the ability to pay for services, the blame lies with him. Paul’s Attorney also said “I’m tired so excuse my behavior”. Actually it does not matter how rested or tired an attorney is, you are EXPECTED to practice Court Room Law in accordance to the states rules and expected decorum.
Paul’s Attorney attempted to have Crysstal Hubbard removed from the Court Room because she was on the Plaintiffs “May Call List”. Because Alec’s Attorney has decided to not call her as a witness, and because the Defense attorney never put her on their witness list, she can no longer be called by either side. Alec also testified that Paul had every opportunity to settle this case for no money, which was definitely something the Jurors picked up on.
Tomorrow the Defense gets to start presenting its case, and we shall see how many of the 30 witnesses they listed as “May Call” are actually called to testify. See you tomorrow folks, as I will wrap up day 3 in the Courtroom.
